Terms and Conditions

Last updated: October 20, 2026

1. Agreement to these Terms

These Terms and Conditions ("Terms") are an agreement between you and Clinic Accelerator Inc., an Alberta corporation with its registered office at 11510 40 Street SE, Calgary, Alberta T2Z 4V6 ("Clinic Accelerator", "PainHero", "we", "us"), governing your use of painhero.ca, its pages, forms, emails and clinic portal (the "Service").

By using the Service, submitting a form, or creating or claiming a clinic listing, you agree to these Terms and to our Privacy Policy and Medical Disclaimer. If you don't agree, please don't use the Service.

Eligibility. You must be at least 18 years old to submit a consult request or create an account. A parent or guardian should use the Service for anyone under 18. If you act for a clinic, you confirm you have authority to bind that clinic to these Terms.

2. The Service, listings and clinic accounts

What PainHero is. PainHero is a directory that helps people find independent clinics and practitioners by symptom, treatment, provider or location. We are not a healthcare provider, and we are not a party to any appointment, treatment or payment between you and a clinic.

Consult requests and bookings. "Free 15-minute consults" are offered by participating clinics only, and availability varies by clinic and location. When you request a consult, we pass your request to the clinic; the clinic decides whether and how to respond. "Book Appointment" buttons take you to the clinic's own booking system, governed by the clinic's terms.

Listing accuracy. Clinic and practitioner profiles come from clinics and from public sources. Ratings and reviews come from third parties such as Google, and some pages show sample "Preview only" content until a clinic connects a live source. Insurance information is display only: PainHero does not verify plan acceptance, eligibility, direct billing or network status. Always confirm details with the clinic and your insurer.

For clinics: claiming a listing. To claim a Premium Listing, you must give accurate contact details, complete a Verification Call, and own or be authorized to act for the clinic. You authorize PainHero to review and extract information from your clinic's public website to build a listing preview. We may decline, edit, suspend or remove any listing at our discretion, including to correct errors or ownership disputes.

For clinics: your account. Keep your login credentials confidential, use multi-factor authentication where offered, and tell us right away about unauthorized use. You are responsible for activity under your account and for the people you add to it. You will handle patient leads you receive in compliance with applicable privacy, health-records and anti-spam laws, and only to respond to the patient's request.

For clinics: fees and referrals. Premium Listings are free. Referral programs, such as employer or insurer preferred provider networks, are offered at our discretion, and we don't guarantee any number of patients, leads, rankings or referrals.

3. No medical advice and acceptable use

No medical advice. Articles, guides, condition pages and other content are for general education only. They are not medical advice and don't replace care from a qualified professional. PainHero does not endorse or guarantee any clinic, practitioner or treatment. Your choice of provider and care is yours.

In an emergency, call 911 or go to the nearest emergency department. If you are in crisis or thinking about harming yourself, call or text 988 (9-8-8 Suicide Crisis Helpline in Canada; 988 Suicide & Crisis Lifeline in the U.S.).

Acceptable use. You agree not to:

  • submit false, misleading or someone else's information, or impersonate a person or clinic;
  • claim a listing you don't own or aren't authorized to manage;
  • post content that is unlawful, defamatory, infringing, or makes false health claims;
  • scrape, crawl or copy the directory or its data at scale, or use it to build a competing database;
  • send spam or use patient leads for anything other than responding to the patient;
  • probe, overload or interfere with the Service or its security, or bypass access controls;
  • use the Service in violation of any law.

4. Intellectual property, your content and third-party links

Our content. The Service, including its design, software, text, graphics, the PainHero name and logo, and "Community Partner" badges, belongs to PainHero or its licensors. We give you a limited, revocable, non-exclusive right to use the Service for its intended purpose. Clinics with a Premium Listing may display the PainHero badge we provide for their city, unaltered, while their listing is active.

Your content. Clinics keep ownership of the content they provide (text, photos, logos, staff bios, articles, job posts, workshops). You grant PainHero a worldwide, royalty-free, non-exclusive licence to host, copy, adapt, display and distribute that content to operate and promote the Service, including on search engines, AI assistants and social media. You confirm you have the rights to everything you submit, including consent from any staff shown, and that it is accurate and lawful.

Profiles and removal. Practitioners or clinics who want a profile corrected or removed can contact us at info@painhero.ca.

Copyright complaints. If you believe content on the Service infringes your rights, email info@painhero.ca with the work, the location of the content and your contact details.

Third-party services. The Service links to or integrates clinic websites and booking systems, Google (Maps, Analytics, Ads, Business Profile reviews), Meta (Instagram, Facebook) and HubSpot. We don't control and aren't responsible for those services; their own terms and policies apply.

5. Disclaimers, limitation of liability and indemnity

Disclaimer. The Service is provided "as is" and "as available". To the fullest extent the law allows, PainHero disclaims all warranties, express or implied, including accuracy, availability, merchantability, fitness for a particular purpose and non-infringement. We don't warrant that listings, reviews, insurance details, hours or availability are complete or current, or that the Service will be uninterrupted or error-free.

Clinics are independent. Clinics and practitioners are independent businesses and professionals, not PainHero's employees or agents. PainHero is not responsible for any care, advice, fees, billing, conduct or outcome from a clinic or practitioner you find through the Service.

Limitation of liability. To the fullest extent the law allows, PainHero and its affiliates, directors, employees and agents are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of the Service. Our total liability for any claim is limited to the greater of the amount you paid PainHero in the 12 months before the claim, or CAD $100. Some jurisdictions don't allow these limits, so they may not fully apply to you; nothing here limits rights you have under consumer protection law that cannot be waived.

Indemnity. You agree to indemnify and hold PainHero harmless from claims, losses and costs (including reasonable legal fees) arising from your content, your misuse of the Service, your breach of these Terms, or, for clinics, your handling of patient information and your services to patients.

6. Termination, governing law, changes and contact

Termination. You can stop using the Service at any time; clinics can ask us to close their account or unpublish their Premium Listing. We may suspend or end your access, or remove a listing, if you breach these Terms or if needed to protect users or the Service. Sections that by their nature should survive (including intellectual property, disclaimers, limitation of liability and indemnity) survive termination. Basic listings compiled from public sources may remain in the directory unless removal is requested.

Governing law. These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada that apply there. You agree to the exclusive jurisdiction of the courts in Calgary, Alberta, except where your local consumer protection law gives you the right to bring a claim where you live.

Changes. We may update these Terms. We'll post the new version here with a new "Last updated" date and email clinic account holders about material changes at least 15 days before they take effect. Continued use after that means you accept the updated Terms.

General. If any part of these Terms is unenforceable, the rest stays in effect. Our failure to enforce a term isn't a waiver. You may not assign these Terms without our consent; we may assign them in a merger, acquisition or sale of assets. These Terms, the Privacy Policy and the Medical Disclaimer are the entire agreement between you and PainHero about the Service.
